Types of Guardianships for Incapacitated Adults

At Hoyle Law, LLC, we can help you establish different types of guardianships, such as:

  • Limited guardianships, which grant only those powers specifically contained in the court order
  • Plenary guardianships, which give the guardian total decision-making authority regarding the ward, the ward's personal needs and effects, and the ward's estate
  • Guardianships over the person
  • Guardianships over the estate

Experienced New Jersey Guardianship Attorney

Because of our knowledge of and experience in guardianship matters, other attorneys often retain our services as an expert witness in guardianship proceedings. Our lead attorney, John G. Hoyle III, is a Certified Master Guardian, one of only a handful in the State of New Jersey.

Adult Parents, Adult Children and Other Family Members

If you are the mother, father, son, daughter or sibling of an incapacitated adult, you need to consider whether everyone's best interests will be served by the creation of a legal guardianship. Other legal provisions that may be viable alternatives to guardianship include representative payee, health care surrogacy, trusts, durable power of attorney for property and/or health care, living wills, joint checking accounts and community services.

It is critical to have an experienced guardianship attorney who will help you understand your options and the consequences of different actions.

We work closely with families who have disabled children, helping them identify whether the creation of a legal guardianship is in everyone's best interests. If a client needs to obtain a court order establishing guardianship, we prepare and file the necessary documentation and represent clients in all legal proceedings.

When you need the skill and experience to help you set up a guardianship for a disabled son or daughter or a conservatorship for an elderly adult, contact our offices. Evening and weekend appointments are available upon request.
