Establishing New Jersey GuardianshipIntervening to Protect Your Loved OnesIt's always sad when our elders lose the mental or physical capacity to manage their own care. Whether it is due to sudden illness or gradual decline, there comes a moment to step in. It's a painful decision — one the elderly person or other family members may not agree with. Hoyle Law, LLC represents clients seeking to establish a guardianship or conservatorship for an incapacitated parent or developmentally disabled adult. We counsel with compassion to preserve the dignity of loved ones while acting quickly to protect them from harm. Contact the law firm to schedule a consultation regarding any of the following:
I am John G. Hoyle III, a Certified Master Guardian* offering 12 years of focused experience in these matters. Based in Monmouth County, my firm serves clients in Ocean Township, Long Branch, Oakhurst and throughout Ocean counties. Call 732-988-9595 to discuss your situation. The Guardianship ProcessTwo doctors must independently certify that the person is incapacitated — unable to manage themselves or manage their personal affairs. The guardianship petition is filed with the probate court, and the court appoints an attorney to represent the person in question (who may oppose the appointment). At a hearing, I work to convince the judge that guardianship is necessary and that you are suited for the role. If you are appointed, I also assist in the many ongoing duties: financial transactions, medical decisions, legal proceedings, and filing an annual accounting of the status of your ward. In certain situations, families may wish to have a third party appointed guardian. Our firm also represents clients who are contesting the appointment of a particular guardian as unfit to provide the best care. Qualifications in Guardianship LawI am a Certified Master Guardian, one of a handful in all New Jersey. The designation by the Center for Guardianship Certification recognizes my demonstrated knowledge and the significant portion of my practice devoted to guardianship and probate law. Local judges frequently appoint me as counsel or legal guardian for individuals without close family, or as special medical guardian for those without a living will. I am also certified as a mediator by the New Jersey Superior Court, often called upon to resolve guardianship disputes. *Certified Master Guardian by Center for Guardian Certification |
